This week, the Texas Supreme Court issued no opinions but issued 12 grants, two of which have been set for oral argument in March and are of particular interest.
On March 1, 2017, the Court will hear Horizon Health Corp. v. Acadia Healthcare Co. Inc., et al. (15-0819) and address whether the trial court’s reduction of attorneys’ fees was proper and whether the appellate court’s take-nothing judgment with regard to lost profits and exemplary damages in the context of disputed noncompete agreements was proper.
Additionally, on March 9, 2017, the Court will hear arguments on In re State Farm Lloyds (15-0903) concerning whether it was an abuse of discretion for the trial court to order production of ESI in “native” formatting rather than searchable static image format.
