On September 28, 2018 the Supreme Court of Texas issued three grants and two corrected opinions. One grant is of particular interest.
In Christopher Medina v. Jennifer L. Zuniga, the Court will address (1) whether a party who failed to admit negligence during discovery but admitted it during trial should be sanctioned for discovery abuse and (2) whether legally sufficient evidence supports the jury’s gross negligence finding. This opinion will analyze these issues in the context of an underlying suit raising negligence and gross negligence claims arising from injuries suffered by a Plaintiff who was struck from behind by a vehicle while she was walking. The oral argument is set for December 4, 2018.
